Niobrara Chalk fish, mosasaurs and pterosaurs come from private ranches by permission; no state permit statute for private land; state lands closed.

Kansas is almost entirely private land, and the Smoky Hill Chalk of the Niobrara Formation — Xiphactinus, mosasaurs, Pteranodon, the inoceramid clams and crinoids — is collected from ranch pastures with the owner's permission. The fossil is the landowner's; commercial collectors work under lease and royalty agreements, and Kansas has no statewide statute regulating fossils on private land.
Kansas Department of Wildlife and Parks land — state parks, wildlife areas, fishing lakes — prohibits removing rocks, minerals and fossils (K.A.R. 115-8). Monument Rocks and Castle Rock are on private land with public access by custom; look, do not collect, unless the owner says otherwise. Cedar Bluff, Kanopolis and the Corps lakes follow federal and state rules.
Road cuts on state highways are KDOT right-of-way; stopping on interstates is illegal and county roads are the usual compromise, with the practical rule of asking the adjacent landowner. The Kansas Geological Survey and the Sternberg Museum (Hays) identify finds and the Sternberg accepts scientifically significant donations.
Verify locally: the Kansas Historical Society's antiquities statute (K.S.A. 74-5401 and following) is written for archaeological sites on state and unmarked burial sites; whether it reaches vertebrate fossils on state land is not explicit.
